GA Army Major Refuses Deployment Orders Over Obama Citizenship Question

I have been pretty much on record that I believe there is nothing to the whole conspiracy theory that Obama is really not a U.S. Citizen. However, since this story does involve a member of the military from Georgia and his law suit against the President has been filed in the Middle District of Georgia, I thought it worthy of Peach Pundit, though it has nothing to do with the Georgia Gang.

According tot he Columbus Ledger-Enquirer,

U.S. Army Maj. Stefan Frederick Cook, set to deploy to Afghanistan, says he shouldn’t have to go.

His reason?

Barack Obama was never eligible to be president because he wasn’t born in the United States.

Cook’s lawyer, Orly Taitz, who has also challenged the legitimacy of Obama’s presidency in other courts, filed a request last week in federal court seeking a temporary restraining order and status as a conscientious objector for his client.

In the 20-page document — filed July 8 with the U.S. District Court for the Middle District of Georgia — the California-based Taitz asks the court to consider granting his client’s request based upon Cook’s belief that Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces.

Cook further states he “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. … simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.”

Cook, a reservist, received the orders mobilizing him to active duty on June 9.

So far the other lawsuits questioning Obama’s citizenship have been dismissed for various reasons, usually based on lack of standing.

You can read the complaint filed in the Federal Court for the Middle District of Georgia here.

I heard that Obama’s birth certificate is stored in the DC safe deposit box as Karen Handel’s high school diploma…

Pappy July 14, 2009 at 12:49 pm

It’s a special kind of crazy that wants a Joe Biden presidency.

At least we could nullify everything BO has signed and make Washington’s ignorance trifecta start over. Maybe we’d hear less about TOTUS, too.

You shouldn’t be doing coke at work drjay.

Doug Deal July 14, 2009 at 1:06 pm

And by worse, I mean much worse.

Game Fan July 14, 2009 at 4:26 pm

I’ll weigh in right now in my belief that Barack Obama was probably born in Mumbassa Kenya. Note to the casual reader: Political operatives aren’t necessarily selected for their fine-tuned ability to get to the hard facts or use logic and common sense. Nope. “reality” to them is “political reality” which is also not very accurate either.

rugby July 14, 2009 at 4:39 pm

By all means then, take the matter court.

And do keep us updated on your progress!

Otherwise, STFU.

rugby July 14, 2009 at 4:39 pm

BTW: Is this going to be the GOP’s answer to the Democrats’ charge of Bush stole the election?

Game Fan July 14, 2009 at 5:20 pm

re: STFU
Hey, I figure that’s an equally valid opinion since the alternate view has been espoused here and, well there’s really no proof whatsoever that he was born in Hawaii.

rugby July 14, 2009 at 5:21 pm

Hey, if you really think that, grow a pair and take it to court.

Or just wuss out.

Game Fan July 14, 2009 at 5:59 pm

If I could afford to take all these politicians to court for every time they did something wrong then how would I have time to blog?

Loren July 15, 2009 at 9:07 am

“Probably born in Mumbassa Kenya”? And on what evidence do you base that conclusion?

For instance, are you aware that Mombasa is *on the other side of country* from where the Obama family and the Luo tribe live? Not only that, but it’s 300 miles directly past Nairobi.

Suggesting that he was born in Mombasa is like suggesting that a French woman married to an American expatriate from Nashville would come to the U.S. to have the baby in Savannah. Well, not quite; you also have to imagine that the French woman would be going to a third-world country to have her baby.

Do you even know where the ‘Mombasa’ rumor truly originated from? On June 9, 2008, Wayne Madsen put an article online that said the following:

“GOP dirty tricks operatives dispatched to Kenya to dig up any useful “dirt” on Democratic presidential nominee Barack Obama, Jr., and his late Kenyan father Barack Obama, Sr., believe they have found a “smoking gun.” In this case, it is a birth certificate from the Kenyan city of Mombasa registering the birth of Barack Obama, Jr., on August 4, 1961. However, the registration is a common practice in African countries whose citizens abroad have families with foreign nationals. ”

The existence of these alleged “GOP dirty tricks operatives” was never verified by any other news agency, or even by Madsen himself. It was, and remains, pure rumor. And obviously, no real Kenyan birth certificate was ever produced by any real dirty tricks operatives.

Plus, Madsen clearly states in the next sentence that even the RUMOR doesn’t claim that the birth was in Kenya, much less Mombasa.

That’s your original source for your belief, sorry to say. An unsubstantiated, unsourced rumor that didn’t actually claim a Kenyan birth at all.

“The truth is out there.”

Steve Perkins July 14, 2009 at 1:01 pm

Exactly. If there had been a soldier suing George Bush over the legality of the Iraq war, the exact same people on both sides would be saying the same things in reverse.

Partisans are morons. Nothing more to see here, move along.

Jason Shepherd July 14, 2009 at 2:17 pm

I still consider myself a partisan.

Chris July 14, 2009 at 2:30 pm

Ok, but a single instance doesn’t prove Steve’s statement.

Game Fan July 14, 2009 at 5:14 pm

Steve
The illogic of calling people partisans over one particular issue is ridiculous. And the whole “nothing to see here” sentiment, is liable to cause someone to violate Godwin’s law. No seriously. I think you may have dictatorial sentiments.

Game Fan July 14, 2009 at 5:22 pm

Some might say “dictatorial tendencies”.

Jason Shepherd July 15, 2009 at 11:31 am

It doesn’t disprove it either.

Bill Simon July 14, 2009 at 6:22 pm

Steve Perkins: Rather than discuss things, he distills his thoughts to 3-second thoughts.

Exactly how much money did you waste of yours (or your family’s or the government’s) for your legal education, Steve?

Steve Perkins July 14, 2009 at 8:29 pm

@GameFan — Saying that something is pointless does not “violate of your human rights”. Godwin?!? Sheesh… melodramatic, much?

@BillSimon — It’s a blog comment, not a legal brief. Keep on using that retort, though… I think the 500th player wins a t-shirt or something.

Bill Simon July 15, 2009 at 9:52 am

Chris July 14, 2009 at 1:11 pm

Bush should never have been President either because Ohio (which he carried twice) was never properly admitted to the Union.

And since Ohio was one of the alleged ratifiers of the 16th amendment you don’t need to pay your income taxes either!

Doug Deal July 14, 2009 at 2:45 pm

And if the flag in the court that tries to convict you has a gold rim, it is an admiralty flag and therefore has no authority over you.

Dash Riptide July 14, 2009 at 3:00 pm

It’s in the U.C.C. so it must be true.

griftdrift July 14, 2009 at 3:03 pm

I don’t see the problem. If Obama is indeed a natural born citizen, why not produce the actual birth certificate? I’ve had to produce mine many times. I had to produce it for my first drivers’ license. I had to produce it for joining the Navy.

Surely Obama and his Obamabots understand that this whole thing would go away if he simply produced a copy of the real birth certificate. Doing so would make these folks look like idiots. Democrats made such a big deal out of McCain being born on a US military base in a foreign land and his eligibility – why is this any different?

I don’t see any “conspiracy”, but I do see a President that looks like he is hiding something.

Dash Riptide July 14, 2009 at 2:00 pm

Loren July 15, 2009 at 9:20 am

“I don’t see the problem. If Obama is indeed a natural born citizen, why not produce the actual birth certificate? I’ve had to produce mine many times. I had to produce it for my first drivers’ license. I had to produce it for joining the Navy.”

I take it that both times you were formally asked to do so? By someone who had the authority to ask you to?

Obama’s not refusing to produce a birth certificate to a court or a judge or a legal authority. He’s simply declining to cowtow to the whims and demands of fringe folks who, for some reason, have singled him out for special treatment in evidencing the details of his birth.

In eight years, was George W. Bush ever asked to produce a birth certificate? In eight years, was Bill Clinton ever asked to PROVE that he was born in Hope, Arkansas? No; people accepted facts as facts, and didn’t manufacture conspiracies about Barbara Bush being in Montreal when she gave birth to Dubya.

I also notice that nobody gives two whits about whether Biden was actually born in Scranton or not. Nobody wants Joe to produce a birth certificate proving his birth, the way they want Obama to.

Besides, when Obama was initially asked to produce a birth certificate, he did. Did that stop the conspiracy theories? No, they just alleged that he’d faked it, or that it wasn’t proof ENOUGH.

Game Fan July 16, 2009 at 5:17 pm

Loren
Maybe Obama wasn’t born in Kenya or Hawaii. And maybe he wasn’t natural born anywhere. His mom coulda had a HICOP (high altitude cesarean over the Pacific)

This lawsuit is great. It highlights the fact that the President has a moral obligation and responsibility to uphold individual life and liberty, and his authority is limited and drawn from the consent of the governed.

seenbetrdayz July 15, 2009 at 11:52 am

You must have this country confused with America.

Dash Riptide July 15, 2009 at 10:52 am

Alyse Knorr must have a very dry sense of humor.

“Cook believes that Obama was ineligible to become president and commander-in-chief because he was is not a natural-born U.S. citizen, the paper reported. Obama was born in Hawaii in 1961.”

http://www.ajc.com/news/nation-world/orders-revoked-on-soldier-91503.html

At no time does Knorr even suggest that Cook believes that Obama was born somewhere other than Hawaii, implying that he believes that being born in Hawaii is in itself insufficient.

Very funny, unless Knorr is under the impression that this is an accurate presentation of the story (in which case it would instead be very, very funny).

Enjoy the schadenfreude, Loaf-sters.

Game Fan July 15, 2009 at 3:04 pm
