Bah. This story deals only with tort law, and is basically just a report from a trade association with an agenda (i.e. “being able to sue a business at all” == “bad climate”).
Georgia is about as pro-business as it gets in contract law, and our treatment of property law is LUDICROUSLY pro-developer. Georgia is the only state in the union that doesn’t retain zoning power at the state level (with about one-third of counties having no zoning at all). We’re also the only state in the union where developers are free to violate covenants up until a development is 100% complete. Yeah, we might as well be communist…
