Expect Murphy to Throw It Out

Harold Murphy is hearing the voter ID law again.

trial in a federal courtroom in northwest Georgia that could determine the fate of the state’s photo voter ID law will resume Thursday.

Several groups joined to sue the state, claiming that requiring voters to show government-issued photo ID at the polls is an unconstitutional impediment to voting. On Wednesday, lawyers for those groups questioned several witnesses including Secretary of State Karen Handel, the state’s chief elections officer. The state, which maintains that photo voter ID is nothing more than a common sense measure to prevent voter fraud, will present its case Wednesday before U.S. District Judge Harold L. Murphy.

I don’t think, being a Murphy, he can abide anything like this.

District judges should not have the power to subvert state law by fiat. Congress should alter jurisdiction to the Circuit court. It is way to easy to shop around for a friendly district judge.
