    Hold it, Conservative Boys and Girls…there may be a problem here. The fetus is an innocent bystander here, right? The fetus wasn’t actively involved in the decision-making process to go rob someone, was it? (he or she)

    IF the Georgia Right to Life is the organization it always claims to be, then they should be about ready to send out a press release demanding that Autry be prosecuted for killing an innocent human.

    I see where you’re going with this, Bill. But, he didn’t know she was pregnant. At that early stage, I’m sure she didn’t know. And though the baby was an “innocent bystander”, the mother wasn’t. The object of his “self defense” was the mother. She’s the one that took that baby’s life by participating in a violent crime. She’s the blame; not this man. I know you’re trying to make a point, but can you imagine how this guy must feel knowing that he was put in a horrible situation that resulted in the death of a woman and her unborn child? He shouldn’t be made an example of for the benefit of a political point. Frankly, I’m sad for him. Yes, he stood up for himself and made us all feel great…Criminals take that! But, the humanity of it is that I’m sure he’s not high-fiving everyone he sees. He just may be thinking about those lost lives. That’s what makes the difference between the criminals and those who prevail over them: criminals don’t care about their victim. Those forced to defend themselves do.

    I too know where you are going and that you are trying to make a point, but I don’t think there is even a sliver of hypocrisy by the Pro-Lifers on this one. It wouldn’t have mattered if the Marine knew she was 6 months pregnant, he was acting in self-defense. The only person that should be held responsible is the mother for putting the child’s life in danger.

    Yeah, Bill, that doesn’t exactly hold water. Who was the criminal element, (or for you civil law folks, the tortfeasor) who was responsible for the incident even occurring?

    Granted, O.C.G.A. 16-5-80(a) says, “A person commits the offense of feticide if he willfully kills an unborn child so far developed as to be ordinarily called ‘quick’ by any injury to the mother of such child, which would be murder if it resulted in the death of such mother.”

    However, in this case, the “willful” criminal act was undertaken by the mother, herself! As such, (and much like felony murder statutes where if someone dies during the commission of a crime the criminal can also be charged with murder) it is THE MOTHER, had she lived and the baby died, who should have been charged with an additional crime as a result of her careless respect for life and the ultimate death of her child.

    Of course, Mayor Franklin, who doesn’t like to be told what laws to enforce in the first place (www.peachpundit.com/?p=1321), probably wouldn’t even have APD bother…

    As a side note, did anyone see on the news this evening the guy who was drunk driving released without a sobriety test by APD to be picked up by a Superior Court Judges wife?

    It turns out the young woman who was killed WASN’T pregnant after all … Here’s report from Wednesday AJC:

    Early police reports indicated Martin was pregnant but the autopsy concluded otherwise, according to the Fulton County Medical Examiner’s office.
