The DUI trial of state Rep. David Graves begins Wednesday in Cobb State Court after his attorneys decided not to appeal a judge’s ruling denying the Macon Republican’s claim of “legislative immunity” in an attempt to avoid the trial.The non-jury trial will be in the courtroom of State Court Judge Irma Glover.Graves invoked a rarely used provision in state law, dating to 1789, to argue that his February arrest at a Vinings DUI roadblock was illegal.

However, Judge Glover ruled Sept. 27 that the legislative immunity provision did not apply to Graves, who argued he was returning from a dinner that involved official legislative business.

    Man if I didnt have things to do (like work) I might drive down to Marietta to watch the fun. Does anybody know if they sell beer at the concession stand at the courthouse? Or at least popcorn?

    I was at the race Sunday and thought it was odd for Sonny, Richardson and Graves to be there giving out an proclamation from the House/Award to Rusty Wallace (Miller Lite) for his service to NASCAR. It was part of the prerace ceromonies and broadcasted over the whole track on the speakers and Video monitors.
