Senator John Cornyn (R-TX) has introduced legislation in the United States Senate to mitigate the Kelo decision. Instead of my suggestion below, Georgia might do well do adopt something simpler, such as Cornyn’s text:
The power of eminent domain shall only be exercised for public use. “Public Use” shall not mean economic development.
I might modify that last bit to read ” . . . mean economic development on behalf of any private entity.”
